Syllabus

Trial court did not err by denying untimely petition for postconviction relief without a hearing. Trial court lacked jurisdiction over the petition because it was not timely filed and petitioner failed to demonstrate that he met the statutory criteria for an exception to the timeliness requirement. Because the trial court lacked jurisdiction over the petition, it was not required to hold a hearing on the petition.
