Syllabus

Alleged error in denial of Appellant's motion for summary judgment is moot or harmless, due to the judgment in Appellee's favor, and the fact that the issues involved were not pure questions of law. Further, the trial court did not err in denying Appellant's motion for a directed verdict, as substantial competent evidence existed to support Appellee's claims, upon which evidence reasonable minds might reach different conclusions. The trial court also did not err in instructing the jury on Appellee's claim for breach of contract. Appellant waived most alleged errors by failing to object, and there was no error, let alone plain error, in the instructions that were given. Finally, the trial court did not abuse its discretion by awarding attorney fees to Appellee, given the jury's finding that Appellant acted in bad faith. Judgment affirmed.
