  • Pay: enters as a guilty plea, points and surcharges assessed.
  • Plea bargain in municipal court: most municipal prosecutors will reduce speeding tickets to non-moving violations like 'unsafe operation' (N.J.S.A. 39:4-97.2) — 0 points and lower fine — for first-time offenders.
  • Trial: municipal court bench trial; appeal to Superior Court Law Division within 20 days for trial de novo on the record.
  • 2. Speed Limits & Reckless Threshold

    N.J.S.A. 39:4-98 sets posted maximums; 39:4-99 prohibits exceeding them.

  • Reckless driving (N.J.S.A. 39:4-96): heedless disregard; up to 60 days jail (first offense), $200 fine, 5 points.
  • Careless driving (39:4-97): 2 points, often used as plea-down.
  • 3. Points & Surcharges

  • 2 points: 1-14 mph over
  • 4 points: 15-29 over
