<p>In this case, the court construed the language of a written contract for supplying materials and labor in constructing water works for the city of Port Wayne, Indiana, in regard to extra work, and an increase in the quantity of work, caused by an alteration of plan; and in regard to defects in materials furnished by. the city, causing delay and expense to the contractor; and reversed-the judgment of the Circuit Court because of an .erroneous construction by it of such language.</p>
