Syllabus

The trial court has the authority to construe certain post-judgment motions for relief as Civ.R. 60(B) motions. When the Civ.R. 60(B) motion purports to disclose new evidence, the motion must be filed within one year of the final judgment and must have a meritorious claim or defense to present.
