State v. Olayinka Alege

Syllabus

The defendant, Olayinka Alege, who was self-represented, appealed from a judgment of conviction and commitment on one count of simple assault and/or battery. On appeal, the defendant contended that the trial justice erred: (1) in denying his motion requesting a Franks hearing; (2) in granting the state's motion in limine seeking leave to present certain evidence pursuant to Rule 404(b) of the Rhode Island Rules of Evidence; (3) in denying his motion to recuse; and (4) in violating the defendant's constitutional rights when sentencing him. The Supreme Court held that the trial justice did not err in his various rulings with respect to the issues on appeal. After carefully considering each of the defendant's grounds for reversal, the Court affirmed the judgment of the Superior Court.
