Can I sue for wrongful termination in South Carolina?

1. At-Will Default

South Carolina is at-will. Small v. Springs Industries, 357 S.E.2d 452 (S.C. 1987).

2. Public Policy Exception

Ludwick v. This Minute of Carolina, 337 S.E.2d 213 (S.C. 1985), recognized a narrow public-policy tort for discharges where (1) the employer requires the employee to violate the law as a condition of employment or (2) the reason for the discharge itself is a violation of criminal law. Lawson v. South Carolina DOC, 532 S.E.2d 259 (S.C. 2000), kept the doctrine narrow.

3. Implied Contract

Recognized in Small v. Springs Industries when handbook is sufficiently specific and lacks a clear at-will disclaimer.
