Can I sue for wrongful termination in Indiana?

1. At-Will Default

Indiana strictly applies at-will. Orr v. Westminster Village North, 689 N.E.2d 712 (Ind. 1997).

2. Public Policy Exception

Frampton v. Central Indiana Gas Co., 297 N.E.2d 425 (Ind. 1973), recognized a retaliatory-discharge tort for filing a workers' comp claim. McClanahan v. Remington Freight Lines, 517 N.E.2d 390 (Ind. 1988), extended to refusing to violate the law. Indiana courts have repeatedly refused to expand the doctrine further (Coutee v. Lafayette Neighborhood Housing Services, 792 N.E.2d 907 (Ind. App. 2003)).

3. Implied Contract

Largely rejected. Orr clarified that handbooks generally do not create contracts absent express promise plus consideration beyond continued employment.

4. Implied Covenant of Good Faith

Not recognized in at-will employment.

5. Statutory Discrimination Claims

Indiana Civil Rights Act (ICRA), Ind. Code § 22-9-1, covers race, sex, age (40-75), disability, religion, ancestry, national origin. Indiana Civil Rights Commission (ICRC) enforces; 180-day charge. No private right of action in court under ICRA without election. Title VII, ADEA, ADA via EEOC within 300 days.

6. Retaliation Statutes

Ind. Code § 22-5-3-3 (public employee whistleblower). Ind. Code § 22-3-2-15 (workers' comp anti-retaliation, also Frampton tort). Federal OSHA § 11(c).

7. WARN Act

No Indiana mini-WARN. Federal WARN applies.

8. Damages

Frampton/McClanahan tort: back pay, compensatory, punitive. ICRA: limited to back pay, reinstatement, no compensatory or punitive in ICRC proceeding. Title VII: capped compensatory/punitive.

9. Statute of Limitations

Frampton/McClanahan: 2 years (Ind. Code § 34-11-2-1 employment limitations); ICRA: 180 days; written contract: 10 years; oral contract: 6 years.
