Can I sue for wrongful termination in Alabama?

1. At-Will Default

Alabama follows strict at-will employment. Hoffman-LaRoche v. Campbell, 512 So.2d 725 (Ala. 1987).

2. Public Policy Exception

Alabama does not recognize a general public-policy wrongful-discharge tort. Howard v. Wolff Broadcasting Corp., 611 So.2d 307 (Ala. 1992); Salter v. Alfa Insurance Co., 561 So.2d 1050 (Ala. 1990). The legislature has created narrow statutory exceptions (e.g., workers' comp).

3. Implied Contract

Hoffman-LaRoche recognized handbooks can modify at-will when offer language is clear, communicated, and accepted by continued employment — but disclaimers typically defeat the claim.

4. Implied Covenant of Good Faith

Not recognized in employment.

5. Statutory Discrimination Claims

Alabama has no comprehensive state anti-discrimination statute. Alabama Age Discrimination in Employment Act (AADEA), Ala. Code § 25-1-20, mirrors federal ADEA for employers of 20+ (private cause of action). Otherwise, plaintiffs rely on Title VII, ADEA, ADA, § 1981 via EEOC charge within 180 days (Alabama is non-deferral; some claims 300 days).

6. Retaliation Statutes

Ala. Code § 25-5-11.1 — workers' comp retaliation. Ala. Code § 36-26A-1 — public employee whistleblower (state employees only). No general private-sector whistleblower statute.
