How do I file a workers' compensation claim in Georgia?

Georgia workers' comp is governed by O.C.G.A. Title 34, Chapter 9, administered by the State Board of Workers' Compensation (SBWC).

1. Coverage

Required for employers with 3 or more employees, regular or part-time (O.C.G.A. § 34-9-2). Excluded: railroad workers (FELA), federal employees, farm laborers, domestic servants, and qualifying independent contractors. Corporate officers may exclude themselves.

2. Notice to Employer

Provide notice within 30 days (O.C.G.A. § 34-9-80). Failure can bar the claim absent reasonable excuse.

3. Claim Filing

File Form WC-14 (Notice of Claim/Request for Hearing) with the SBWC within 1 year of injury, or 1 year from last authorized medical treatment, or 2 years from last weekly benefit (O.C.G.A. § 34-9-82).

4. Benefits

Medical 100% covered through authorized providers. Temporary Total Disability (TTD) pays 2/3 of average weekly wage up to state max (about $800/week in 2026), limited to 400 weeks for non-catastrophic. Temporary Partial Disability (TPD) up to 350 weeks. Permanent Partial Disability (PPD) under § 34-9-263 schedule. Catastrophic designation under § 34-9-200.1 unlocks lifetime benefits. Death benefits and $7,500 burial.

5. Independent Medical Exam (IME)

Employee has a one-time right to an IME at carrier expense under § 34-9-202. Carrier may also require examinations.

6. Choice of Doctor

You must select an authorized treating physician from the employer's posted Panel of Physicians (minimum 6 doctors) under § 34-9-201. One-time change to another panel physician allowed without permission.

7. Denied Claim / Appeal

SBWC Administrative Law Judge holds a hearing. Appeal to the Appellate Division within 20 days, then to Superior Court, then Court of Appeals.

8. Third-Party Suit

Section 34-9-11.1 preserves third-party claims. Employer/carrier has subrogation lien but only if the employee is fully and completely compensated (a high bar in Georgia practice).
