How do I file a workers' compensation claim in Colorado?

Colorado workers' comp is governed by C.R.S. Title 8, Articles 40 through 47, administered by the Division of Workers' Compensation (DOWC).

1. Coverage

Required for all employers with 1+ employee (C.R.S. § 8-40-202). Excluded: casual workers not in trade/business, some real estate agents/brokers, qualifying independent contractors, and certain domestic and agricultural workers under thresholds.

2. Notice to Employer

Written notice within 10 days of injury (C.R.S. § 8-43-102(1)(a)). Late notice reduces benefits one day per day late unless reasonable excuse; absolute bar after employer pleads prejudice.

3. Claim Filing

File Form WC15 (Worker's Claim for Compensation) with DOWC within 2 years of injury, extended to 3 years for good cause (C.R.S. § 8-43-103(2)).

4. Benefits

Medical 100% covered. Temporary Total Disability pays 66 2/3% of average weekly wage subject to state max (91% of state average — about $1,317/week for 2026) under § 8-42-105. Temporary Partial Disability under § 8-42-106. Permanent Partial Disability — scheduled losses (§ 8-42-107) or whole-person impairment with combined value cap. Permanent Total Disability for life (§ 8-42-111). Death benefits and $7,000 funeral.

5. Independent Medical Exam (IME)

After MMI, either party may request a Division IME (DIME) under § 8-42-107.2 to challenge the authorized treating physician's MMI or impairment rating. DIME opinion is given clear-and-convincing-evidence weight.

6. Choice of Doctor

Employer designates the authorized treating physician (or provides a choice of 2 if registered) under § 8-43-404. One-time change of physician available.

7. Denied Claim / Appeal

Administrative Law Judge holds hearing through the Office of Administrative Courts. Appeal to the Industrial Claim Appeals Office (ICAO) within 20 days, then to the Colorado Court of Appeals (§ 8-43-301).

8. Third-Party Suit

C.R.S. § 8-41-203 preserves third-party rights. Carrier has subrogation lien — reduced for pro-rata attorney's fees and costs.
