How do I file a workers' compensation claim in Arizona?

Arizona workers' comp is governed by A.R.S. Title 23, Chapter 6, administered by the Industrial Commission of Arizona (ICA).

1. Coverage

Required for all employers with 1+ employee (A.R.S. § 23-961). Excluded: casual employees not in trade/business, domestic servants in private homes, independent contractors meeting statutory criteria, and certain working partners/proprietors.

2. Notice to Employer

Report the injury "forthwith" (A.R.S. § 23-908). While no exact day count, delays jeopardize the claim.

3. Claim Filing

File ICA Form 407 (Worker's and Physician's Report of Injury) within 1 year of injury (A.R.S. § 23-1061(A)). For occupational disease, 1 year from when the worker knew or should have known of work-relatedness.

4. Benefits

Medical 100% covered. Temporary Total Disability pays 66 2/3% of average monthly wage subject to a statutory cap on average monthly wage ($6,144/month for 2026 injuries) under A.R.S. § 23-1041. Temporary Partial under § 23-1044(A). Permanent Partial scheduled under § 23-1044(B) or unscheduled under § 23-1044(C). Permanent Total under § 23-1045 for life. Death benefits under § 23-1046 plus $5,000 burial.

5. Independent Medical Exam (IME)

Carrier may require IME under § 23-1026. Refusal suspends benefits.

6. Choice of Doctor

The employee generally chooses the treating physician. If the employer or carrier elects to direct care, the employee must accept the designated doctor; otherwise free choice applies (A.R.S. § 23-1070).

7. Denied Claim / Appeal

Notice of Claim Status from the carrier is protested by Request for Hearing within 90 days. Administrative Law Judge holds hearing; appeal to ICA review, then special action to the Arizona Court of Appeals.

8. Third-Party Suit

A.R.S. § 23-1023 preserves third-party rights. Carrier has lien for benefits paid; subrogation may be reduced for pro rata attorney's fees.
