What are tenant rights in Arizona?

Arizona tenant rights are governed by the Arizona Residential Landlord and Tenant Act (ARLTA), A.R.S. § 33-1301 et seq.

1. Security Deposit — Capped at 1.5 months' rent (excluding pet deposits or non-refundable fees) under A.R.S. § 33-1321. Landlord must return within 14 business days of termination with an itemized list of deductions. Tenant has the right to be present at move-out inspection.

2. Habitability — § 33-1324 requires landlords to comply with building, housing, and health codes; make all repairs to keep premises fit and habitable; maintain common areas; supply running water, hot water, and reasonable heat (Oct 1-May 1).

3. Tenant Remedies — § 33-1361 to § 33-1365 provide self-help repair (limited to $300 or half of monthly rent), rent withholding via court escrow, lease termination after 5 days' written notice for material noncompliance, and damages.

4. Notice for Entry — § 33-1343 requires 2 days' notice for non-emergency entry.

5. Eviction Notice — § 33-1368 requires a 5-day pay-or-quit notice for nonpayment of rent and a 10-day notice for non-rent lease violations (with right to cure).

6. Termination of Month-to-Month — § 33-1375 requires 30 days' written notice.

7. Rent Control — Prohibited by A.R.S. § 33-1329.

8. Discrimination — Arizona Fair Housing Act (§ 41-1491) mirrors federal protections. No state-level source-of-income or sexual orientation protection (though Phoenix, Tucson, Tempe, Flagstaff have local protections).

9. Retaliation — § 33-1381 prohibits retaliation for 6 months after tenant complaint to government, joins tenant union, or asserts statutory rights.

10. Lockouts and Utility Shutoffs — § 33-1367 prohibits landlord self-help; treble damages plus 2 months' rent.
