What pretrial diversion or drug court programs exist in Virginia?

Virginia's diversion statutes are spread across Title 18.2 and Title 19.2.

1. Pretrial Intervention / Diversion (DA-Run). Commonwealth's Attorneys in many jurisdictions (Fairfax, Arlington, Norfolk) operate pretrial diversion or deferred prosecution programs. No general statute; rests on prosecutorial discretion.

2. Statutory Deferred Adjudication / Judicial Diversion. Va. Code § 19.2-298.02 (Deferred Disposition) authorizes the court, upon agreement, to defer findings and place defendant on probation; dismissal on completion. Available for many non-violent offenses.

3. Drug Court / Drug Treatment Court. Va. Code § 18.2-254.1 establishes Drug Treatment Court Act; State Drug Treatment Court Advisory Committee oversees 50+ statewide.

4. Veterans Treatment Docket. Va. Code § 2.2-2625 and Veterans Docket statute (Va. Code § 18.2-254.2) authorize veterans dockets.

5. Behavioral Health Docket. Va. Code § 18.2-254.3 authorizes behavioral health (mental health) dockets.

6. DUI Court. Authorized under § 18.2-254.1; ignition interlock under § 18.2-270.1; restricted licenses under § 18.2-271.1.

7. Youthful Offender / First Offender. No general young-adult statute; juveniles under Title 16.1. Va. Code § 19.2-303.6 governs alternative sentencing for non-violent.

8. First-Time-Offender Statute. Va. Code § 18.2-251 (drug first-offender) dismisses first-time drug possession after completion of probation, community service, and DSE. Va. Code § 18.2-57.3 (DV first-offender) similar. Expungement under § 19.2-392.2 (limited; Virginia's expungement is narrow but expanded under 2025 reform § 19.2-392.6 sealing).

9. Effects. Completion = dismissal; sealing under § 19.2-392.6 (effective 2026) automates sealing for many non-convictions and minor convictions. Federal databases not erased.

10. Federal Pretrial Diversion. 18 U.S.C. § 3154; EDVA and WDVA operate PTD programs.
