What pretrial diversion or drug court programs exist in Pennsylvania?

Federal & State Law Editorial TeamLast reviewed: 2026-05-18

Pennsylvania's diversion regime centers on ARD and a growing network of specialty courts.

1. Pretrial Intervention / Diversion (DA-Run). County DAs operate Accelerated Rehabilitative Disposition (ARD) under Pa.R.Crim.P. 300-320. First-time, non-violent defendants complete 6-24 months of supervision; charges dismissed and record eligible for expungement under 18 Pa.C.S. § 9122.

2. Statutory Deferred Adjudication / Judicial Diversion. ARD is the primary judicial diversion. 18 Pa.C.S. § 17 governs disposition in lieu of trial/sentence. Section 17 of the Controlled Substance Act (35 P.S. § 780-117) authorizes probation without verdict for first-time drug offenders, leading to dismissal and expungement.

3. Drug Court. Authorized under 35 P.S. § 780-117 and Pa.R.Crim.P. 100 et seq.; 39 of 67 counties operate certified drug treatment courts.

4. Veterans Treatment Court. 42 Pa.C.S. § 916 authorizes Veterans Court; first opened in Lackawanna County 2009; now in 30+ counties.

5. Mental Health Court. Authorized administratively by AOPC; counties including Philadelphia, Allegheny, Bucks, and Lehigh operate them; coordinates with county MH/IDD.

6. DUI Court. 75 Pa.C.S. § 3815 authorizes DUI treatment court for repeat offenders; ignition interlock under 75 Pa.C.S. § 3805.

7. Youthful Offender / Juvenile. No general youthful offender act, but 42 Pa.C.S. § 6354 governs juvenile dispositions; consent decrees under § 6340 act like juvenile diversion.

8. First-Time-Offender Statute. Pennsylvania's Clean Slate Act (18 Pa.C.S. § 9122.2) provides automatic sealing of certain non-violent convictions after 10 years; petition-based sealing under § 9122.1.

9. Effects. ARD and § 17 dispositions are not convictions; expungement available immediately after completion. Federal effects vary: ARD-DUI counts as prior under federal sentencing recidivism in some circuits.

10. Federal Pretrial Diversion. 18 U.S.C. § 3154; EDPA, MDPA, WDPA each operate small PTD; uncommon.
