What pretrial diversion or drug court programs exist in New Jersey?
New Jersey's diversion statutes are uniform statewide under Title 2C.
1. Pretrial Intervention / Diversion (DA-Run). N.J.S.A. 2C:43-12 to -22 (Pretrial Intervention Program, PTI) is administered jointly by the prosecutor and the PTI Director (probation). 2. Statutory Deferred Adjudication / Judicial Diversion. 8. First-Time-Offender Statute. Expungement under N.J.S.A. 2C:52-1 to -32; "clean slate" under 2C:52-5.3 after 10 years; PTI/CD/CDP completions are expungeable after 6 months under 2C:52-6.
9. Effects. Completion = dismissal and expungeable. Federal databases persist.
10. Federal Pretrial Diversion. 18 U.S.C. § 3154; DNJ operates a PTD program; uncommon.
