Federal & State Law Editorial TeamLast reviewed: 2026-05-18

Michigan's diversion regime is built around statutory deferrals and specialty problem-solving courts.

1. Pretrial Intervention / Diversion (DA-Run). County prosecutors run informal pretrial diversion; conditions include restitution, community service, and counseling. No general statute; authority derives from prosecutorial discretion.

2. Statutory Deferred Adjudication / Judicial Diversion. MCL § 333.7411 defers entry of judgment for first-time drug possession; completion dismisses without conviction. MCL § 769.4a defers DV; MCL § 750.350a defers parental kidnapping; MCL § 750.430 defers health-professional offenses.

3. Drug Treatment Court. MCL §§ 600.1060-1075 authorize drug treatment courts; State Court Administrative Office (SCAO) certifies them. 75+ statewide.

4. Veterans Treatment Court. MCL §§ 600.1200-1212; veterans courts in 30+ counties.

5. Mental Health Court. MCL §§ 600.1090-1099d; mental health courts statewide.

6. Sobriety / DWI Court. MCL §§ 600.1080-1088 authorize sobriety courts; ignition interlock under MCL § 257.625k; combined with DWI diversion.

7. Youthful Offender (HYTA). MCL § 762.11 (Holmes Youthful Trainee Act) lets defendants 17-25 (24 if offense before 21, under amended law) plead guilty without judgment of conviction; successful completion = dismissed and sealed.

8. First-Time-Offender Statute. Beyond HYTA and § 7411, set-aside under MCL § 780.621 (Clean Slate Act) allows automatic expungement of certain misdemeanors after 7 years and felonies after 10.

9. Effects. HYTA, § 7411, § 4a completions = no public conviction record. Federal databases not automatically purged.

10. Federal Pretrial Diversion. 18 U.S.C. § 3154; EDMI and WDMI operate small PTD programs.
