How do I sue police for misconduct in Massachusetts?

1. Federal Statute. 42 U.S.C. § 1983 creates a cause of action against state actors who deprive plaintiffs of federal constitutional rights under color of law.

2. Qualified Immunity. The First Circuit applies federal QI under Saucier/Pearson. Massachusetts state-law claims under the MCRA are not subject to federal QI.

3. Massachusetts State-Law Alternative. The Massachusetts Civil Rights Act (M.G.L. c. 12 §§ 11H-11J) creates a private right of action when "any person" interferes with the exercise of constitutional rights by "threats, intimidation, or coercion." The 2020 Massachusetts police-reform statute (Ch. 253 of the Acts of 2020) narrowed QI: an officer is not entitled to QI when "no reasonable defendant could have believed the conduct was lawful." It also created a state decertification commission.

4. Monell Liability. A municipality is liable under § 1983 only when an official policy, custom, or failure to train caused the constitutional violation.

5. Statute of Limitations. Section 1983 and MCRA borrow Massachusetts's 3-year personal-injury SOL (M.G.L. c. 260 § 2A). State-tort claims against public employers under the Mass. Tort Claims Act require 2-year notice under M.G.L. c. 258 § 4.

6. Common Constitutional Claims. Fourth Amendment excessive force, unlawful arrest, and unlawful search; Eighth Amendment for post-conviction abuse; Fourteenth Amendment due-process and equal-protection violations.

7. Damages. Compensatory and punitive damages (punitives only against individual officers), plus 42 U.S.C. § 1988 and M.G.L. c. 12 § 11I attorney fees.

8. Notice of Claim. Mass. Tort Claims Act § 4 requires written notice within 2 years for tort claims against public employers; § 1983 and MCRA claims have no notice requirement.

9. Bivens. Federal-officer Bivens claims have been narrowed by Egbert v. Boule (2022).
