What are the open container laws in Ohio?

Ohio's open container statute applies on streets and highways, and Ohio has carved out a robust framework for municipal "DORA" entertainment districts.

1. Statutory Rule — R.C. § 4301.62

  • No person shall have in their possession an opened container of beer or intoxicating liquor:
  • - In a motor vehicle, except as provided by R.C. § 4301.62(D) (chauffeured vehicle exemption).

    - On the premises of a permit holder unless authorized.

    - In any public place except where authorized.

    2. Penalty

    Minor misdemeanor — fine up to $150, no jail. Does not carry court-imposed driving points unless paired with a moving violation. Stays on record but not classified as a "criminal" misdemeanor for most employment background-check purposes.

    3. Vehicle Exemptions

  • Trunk or other area not normally occupied by the driver or passengers.
  • Living quarters of a house car (motorhome).
  • Passenger of a chartered bus, taxicab, limousine, or motor coach operated by a Class D-5 permit holder or commercial driver.
  • 4. Driver vs Passenger

    Both can be charged. A passenger drinking a beer while the driver stays sober still triggers § 4301.62 for both unless the chauffeured-vehicle exemption applies.

    5. DORA Districts

    R.C. § 4301.82 authorizes municipalities to designate "Designated Outdoor Refreshment Areas" — local entertainment zones where adults may carry open containers (in DORA-branded cups) from one licensed establishment to another. Active DORAs include parts of Cincinnati (Over-the-Rhine), Columbus (Short North), Cleveland (Flats East Bank), Toledo, Akron, Sandusky, and dozens of smaller cities.

    6. Public Consumption Elsewhere

    Outside a DORA, public drinking is banned by municipal ordinance in essentially every city — typical fine $100–$250.

    7. Tailgating

    In stadium lots, the trunk exemption is the safe harbor; consumption inside the vehicle is prohibited.
