How do I get a marriage license in Illinois?

Federal & State Law Editorial TeamLast reviewed: 2026-05-17

Illinois requires county-specific application and a one-day delay before the ceremony.

1. Where to Apply

  • The county clerk in the Illinois county where the wedding will be held (750 ILCS 5/203).
  • Both parties must appear; the license is only valid in that county.
  • 2. ID and Documents

  • Government-issued photo ID and Social Security number.
  • If previously married, bring proof of divorce or death of prior spouse.
  • 3. Fees

  • $30-$100 by county (Cook County $60; collar counties $30-$75).
  • 4. Waiting Period and Expiration

  • No traditional waiting period, but the license becomes effective the day after issuance (750 ILCS 5/207) — you cannot marry same-day.
  • Valid for 60 days from issuance.
  • 5. Age and Residency

  • 18 minimum. 16-17 may marry with judicial approval and parental consent (750 ILCS 5/208).
  • No residency requirement — but ceremony must occur in the issuing county.
  • 6. Blood Test and Same-Sex Marriage

  • No blood test required (eliminated 1989).
  • Same-sex marriage legal since the Illinois Religious Freedom and Marriage Fairness Act (effective June 1, 2014), confirmed by Obergefell (2015).
