Florida marriage licensing favors couples who complete premarital education and out-of-state couples planning destination weddings.

1. Where to Apply

  • Any Florida county clerk (Fla. Stat. § 741.01).
  • Both parties appear together; license usable statewide.
  • 2. ID and Documents

  • Valid photo ID and Social Security number.
  • If divorced: date of finalization (no waiting period after divorce, but be prepared to disclose).
  • 3. Fees

  • $86 standard.
  • $61 with a certificate showing completion of a registered 4-hour premarital preparation course (Fla. Stat. § 741.0305).
  • 4. Waiting Period and Expiration

  • 3-day waiting period for Florida residents (Fla. Stat. § 741.04).
  • Waived for: (a) completion of premarital course, or (b) non-Florida residents.
  • License valid 60 days from issuance.
  • 5. Age and Residency

  • 18 minimum. 17-year-olds may marry with parental consent, but only if the partner is no more than 2 years older (Fla. Stat. § 741.0405, reformed 2018). No marriage under 17.
  • No residency requirement — Florida is a popular destination wedding state.
  • 6. Blood Test and Same-Sex Marriage

  • No blood test required (eliminated 1986).
  • Same-sex marriage legal since Brenner v. Scott (N.D. Fla. 2014) and Obergefell (2015).
