How do I fight a speeding ticket in Ohio?

Ohio speeding tickets are processed by municipal, county, or mayor's courts.

1. Pay vs. Contest

  • Waiver (pay): admission of guilt, conviction goes to BMV abstract.
  • Appear in court: arraignment, then bench or jury trial. Many courts offer 'safe driving' or 'no operator's license' amendments to avoid points.
  • Mayor's courts: many small Ohio municipalities use mayor's courts (ORC Ch. 1905). You can request transfer to municipal court (ORC § 1905.032) for a more formal proceeding.
  • 2. Speed Limits & Reckless Threshold

    ORC § 4511.21 sets prima facie limits and the basic-speed rule. Default rural interstate maximum is 70 mph; urban is 65 mph.

  • Reckless operation (ORC § 4511.20): willful/wanton disregard, minor misdemeanor or higher with priors.
  • Aggravated vehicular operation comes in at extreme speeds with priors.
  • 3. Points & Insurance

  • 2 points: under 30 mph over
  • 4 points: 30+ mph over (and any reckless operation)
  • 12 points/2 years = 6-month BMV suspension; 6 points triggers a warning letter; 8 points within 3 years can require a remedial driving course.

    4. Remedial Driving Course

    ORC § 4510.038 — a state-approved 4-hour course can reduce 2 points. Take once per 3 years; CDL holders ineligible to mask a CDL conviction.

    5. Defenses & Discovery

  • Subpoena officer under Crim. R. 17.
  • Request radar/laser certification (each device must be admissible — East Cleveland v. Ferell line of cases requires evidence of accuracy).
  • Pacing must show same direction, similar speed, sufficient distance.
