How do I fight a speeding ticket in Massachusetts?

Massachusetts uses a two-tier appeal system that gives drivers real leverage.

1. Pay vs. Contest

  • Pay: 20-day response window; admission of responsibility.
  • Clerk-Magistrate Hearing: $25 filing fee, request within 20 days. Informal hearing before a Clerk-Magistrate — no rules of evidence, fast and cheap. Officer often does not appear; if not, dismissal. Magistrate can find Not Responsible, Responsible (assess fine), or Responsible (no fine).
  • District Court Judge Appeal: $50 fee, request within 10 days of Magistrate decision. Formal hearing before a judge — officer must testify, rules of evidence apply. This stage is where most reductions are negotiated.
  • 2. Speed Limits & Reckless Threshold

    MGL Ch. 90 § 17 sets posted limits; § 18 governs basic speed.

  • Reckless operation (MGL Ch. 90 § 24(2)(a)): misdemeanor — up to 2 years jail, $200 fine, mandatory 60-day suspension.
  • Operating to endanger: also a misdemeanor.
  • 3. Surchargeable Incidents (SDIP)

    The Registry (RMV) assigns surcharge points to incidents (Merit Rating Board):

  • 2 points: minor moving violation (most speeding)
  • 3 points: minor at-fault accident
  • 4 points: major moving violation
  • 5 points: major at-fault accident / DUI
  • Each surcharge point increases insurance premiums 7-15%, lasting 6 years on the Merit Rating Board record.

    4. License Points

    MA does not have a numeric license point system. Suspensions follow specific events: 3 speeding within 12 months = 30-day suspension; 7 surchargeable in 3 years = 60-day suspension.

    5. Defenses & Discovery

  • Subpoena radar/lidar calibration log via the clerk's office.
  • Commonwealth v. Buckley — defense can challenge stop pretext.
  • Ask officer for radar specs, distance, traffic at the hearing.
  • 6. CDL Holders

    49 CFR § 384.226 — no diversionary masking of CMV convictions.
