How do I fight a parking ticket in New York?

New York has two distinct systems — NYC's Parking Violations Bureau (PVB) and upstate municipal/town courts.

1. NYC — Parking Violations Bureau (VTL § 235-239)

  • 30 days from issuance to plead not guilty.
  • Options: online at NYC.gov/PayOrDispute, by mail, or in person at a Business Center.
  • Three hearing methods: (i) Hearing by Web — upload photos/argument; (ii) Hearing by Mail; (iii) In-person hearing before an Administrative Law Judge.
  • Decision issued same day for in-person hearings, within 8 weeks for mail/web.
  • 2. Upstate / Other NY

  • Tickets are heard in town, village, or city court.
  • Plead not guilty by signing the back of the ticket and mailing within the deadline printed (usually 15-30 days).
  • A court date is scheduled; trial under VTL § 1806.
  • 3. Common Defenses

  • Defective sign — faded, missing, contradictory.
  • No Standing Anytime sign was not posted at the location.
  • Meter malfunction — 35 RCNY § 4-08(h)(3) permits parking at a broken meter for the posted time.
  • Valid commercial plates loading/unloading (NYC has 3-hour rule).
  • Wrong plate, body type, or color on the citation — must include at least 3 correct elements.
  • Disabled placard properly displayed.
  • 4. Late Penalties

  • After 30 days: $10 late fee.
  • After 75 days: judgment entered, additional penalties.
  • After 100 days: increased default penalty.
  • 5. Booting and Credit Impact

  • 3+ unpaid judgments make a vehicle eligible for booting/towing by the Sheriff or Marshal.
  • NYC PVB judgments are entered with the NYS Department of State as civil judgments and can appear on credit reports.
  • 6. Appeals

  • Appeal an adverse PVB decision within 30 days to the PVB Appeals Board ($25 fee).
  • Further appeal to Supreme Court via Article 78 proceeding (CPLR Art. 78).
