Can my employer drug test me in Virginia?

2. State Drug-Testing Statute

Virginia has no comprehensive private-employer testing law. Public-sector testing limited by constitutional privacy rights. Va. Code § 40.1-27.4, effective July 1, 2021, prohibits employers from discharging, disciplining, or discriminating against employees for lawful use of cannabis oil pursuant to a valid certification from a practitioner under Va. Code § 54.1-3408.3.

5. Marijuana Considerations

Recreational cannabis legalized 2021 (Va. Code § 4.1-1100 et seq.) but no employment protections for recreational use. Medical cannabis oil protections under § 40.1-27.4 limited to certified patients—and exceptions exist: (a) federal contractor compliance, (b) safety-sensitive positions requiring testing per federal law, (c) inability to perform duties safely, (d) on-duty use or impairment.

6. Safety-Sensitive Carve-Outs

DOT-covered positions per 49 C.F.R. Part 40. § 40.1-27.4(B)(2) excepts positions requiring federal-law compliance. Defense, nuclear, and law enforcement excluded.

7. ADA / Disability

Current illegal drug use not protected under Virginia Human Rights Act (Va. Code § 2.2-3900) or ADA. Recovering addicts in supervised treatment protected.

8. Remedies for Improper Test

§ 40.1-27.4 violations: limited remedy via VHRA framework. Wrongful discharge in violation of Bowman public policy narrow. Defamation, invasion of privacy, breach of contract possible.
