Can my employer drug test me in Maryland?

1. Federal Framework

2. State Drug-Testing Statute

Md. Code, Health-Gen. § 17-214 requires private employers conducting drug or alcohol testing to: (a) use a state-certified laboratory, (b) provide the employee/applicant with a copy of the test results and procedures within 30 days of testing, (c) ensure confidentiality. Md. Code, Lab. & Empl. § 17-101 governs additional workplace conduct. Public-sector testing constrained by Md. Const. and case law.

3. Test Categories

All categories permitted: pre-employment, random, reasonable suspicion, post-accident, return-to-duty.

4. Required Procedures

Per Health-Gen. § 17-214: state-certified lab required; written copy of result and chain of custody must be provided to employee/applicant within 30 days. Best practice: written policy, immunoassay screen with GC/MS confirmation, MRO review.

5. Marijuana Considerations

Cannabis Reform Act, effective July 1, 2023, legalized recreational use for adults 21+. Md. Code, Alcoholic Beverages and Cannabis § 36-401 et seq. Medical cannabis (Md. Code, Health-Gen. § 13-3301 et seq.) similarly preserves employer rights. Neither law requires accommodation of workplace use or impairment, and neither provides off-duty use protections—employers may continue to test for and discipline cannabis use.

6. Safety-Sensitive Carve-Outs

DOT-covered positions per 49 C.F.R. Part 40. Healthcare workers handling controlled substances. Law enforcement, firefighters, security personnel.

7. ADA / Disability

Current illegal drug use not protected under Md. Code, State Gov't § 20-606 or ADA. Recovering addicts in treatment protected. Medical cannabis use not protected as accommodation per § 13-3313(c).

8. Remedies for Improper Test

Health-Gen. § 17-214 violations: misdemeanor with fines up to $100 per violation. Wrongful discharge in violation of public policy (Adler). Defamation, invasion of privacy, breach of contract.
