How do I resolve an easement or boundary dispute in Ohio?

Federal & State Law Editorial TeamLast reviewed: 2026-05-18

1. Easement Types

Ohio recognizes express easements (written, recorded under Ohio Rev. Code § 5301.01), easements by necessity, implied easements from prior use, prescriptive easements, and easements by estoppel.

2. Adverse Possession Elements

Ohio Rev. Code § 2305.04 (21-year statute). Elements: exclusive possession, open, notorious, continuous, and adverse for 21 years (Grace v. Koch, 692 N.E.2d 1009). Burden on claimant by clear and convincing evidence.

3. Prescriptive Easement

21-year continuous, open, notorious, adverse use under claim of right (J.F. Gioia v. Cardinal American, 492 N.E.2d 822). No tax payment required.

4. Quiet Title Action

Ohio Rev. Code Ch. 5303 (§§ 5303.01-5303.40). File in common pleas court of county where land located. Action determines all claims to title and possession.

5. Boundary Disputes

Ohio recognizes boundary by agreement (uncertain line + agreement) and boundary by acquiescence. Licensed Ohio surveyor required for accurate determination.

6. Encroachment Remedies

Ohio courts apply relative hardship doctrine for innocent encroachments; mandatory removal more likely for willful intrusions. Damages may substitute where removal cost is grossly disproportionate.

7. Express Easement Termination

Release, merger, abandonment (nonuse plus clear intent), expiration. Mere nonuse for any period is insufficient.

8. Marketable Title Act

Ohio Rev. Code § 5301.47 et seq.: a person with an unbroken chain of title for 40 years has marketable record title, free of pre-root interests unless preserved by recorded notice.

9. Litigation / Mediation

Common pleas court for title actions. Court-annexed mediation widely available under Sup.R. 16. Municipal court for smaller boundary claims.
