What happens if I get a DWI in North Carolina?

North Carolina's DWI sentencing structure is unique: judges use a five-level system based on aggravating, grossly aggravating, and mitigating factors found at the sentencing hearing.

1. Per Se BAC Standard

N.C. Gen. Stat. § 20-138.1 sets adult per se DWI at 0.08% BAC; § 20-138.2 sets commercial driver per se at 0.04%; § 20-138.3 ("Driving by Person Less Than 21 After Consuming") sets zero tolerance for under-21 drivers.

2. Implied Consent

N.C. Gen. Stat. § 20-16.2 requires submission to chemical testing. A first willful refusal triggers a 12-month civil license revocation by the NC DMV plus a 30-day civil revocation under § 20-16.5, separate from any criminal penalty.

3. First-Offense Penalties

Sentencing levels: Level 5 (24 hours-60 days, $200 fine), Level 4 (48 hours-120 days, $500), Level 3 (72 hours-6 months, $1,000), Level 2 (7 days-1 year mandatory, $2,000), Level 1 (30 days-2 years mandatory, $4,000), Aggravated Level 1 (12-36 months mandatory, $10,000). 12-month license revocation; limited driving privilege available after 10 days under § 20-179.3.

4. Enhancements

Grossly aggravating factors include prior DWI within 7 years, driving while license revoked for impaired driving, serious injury, or child under 18 in vehicle (§ 20-179(c)). Habitual DWI (4th DWI in 10 years) under § 20-138.5 is a Class F felony with 12-month mandatory minimum.

5. Administrative License Suspension (ALS)

Immediate 30-day pre-trial Civil License Revocation under § 20-16.5 if BAC 0.08%+ or refusal. You may request limited driving privilege after 10 days. Refusal triggers a separate 12-month DMV revocation.

6. Court Process

First appearance in District Court, pretrial discovery, motions to suppress (G.S. § 15A-974), bench trial in District Court, with right to de novo jury trial in Superior Court.

7. Long-Term Consequences

SR-22 insurance, federal CDL disqualification for 1 year (49 C.F.R. § 383.51), DWI convictions are not expungeable under § 15A-145.5, mandatory substance-abuse assessment, and 28-day inpatient treatment for Level 1/Aggravated Level 1.
