Can I Return a Used Car?

Unlike many consumer purchases, buying a used car generally does not come with a right to return it. However, several legal protections may apply.

No federal cooling-off period. The FTC's Cooling-Off Rule (which gives you 3 days to cancel certain purchases) does NOT apply to vehicles.

State protections:

  • Used car lemon laws — Some states (New York, Massachusetts, Connecticut, and others) have lemon laws covering used vehicles. These typically apply to cars under a certain age or mileage and require the dealer to repair or refund if defects are found.
  • Cooling-off periods — A few states or local jurisdictions provide a short return window for used cars (California offers a 2-day option for an additional fee).
  • When you may be able to return a used car:

  • Fraud — The dealer misrepresented the condition, mileage, or history of the vehicle.
  • Undisclosed defects — The dealer knew about a significant defect and failed to disclose it.
  • Title problems — The car has a salvage title, lien, or stolen status that was not disclosed.
  • Warranty breach — The car fails under an express or implied warranty.
  • Contract errors — The sales contract was not completed properly.
  • "As is" sales. Buying "as is" generally means you accept the car in its current condition, but "as is" does not protect the dealer from fraud claims.

    Dealer vs. private sale. You have fewer protections when buying from a private seller. Implied warranties typically do not apply.

    Steps to take. Review the contract, check your state's specific protections, document defects, and contact the dealer in writing.
