How does bail work in Arizona?

1. Constitutional Framework

Ariz. Const. art. II, § 22 (amended by Prop. 100) makes serious felonies, sexual assault, and certain offenses by undocumented immigrants nonbailable. Otherwise, bail is presumed.

2. Cash, Surety, Property, OR Bonds

Rule 7.3 lists conditions: ROR, unsecured appearance bond, third-party custody, secured bond (cash, surety, property).

3. Bail Hearing

Rule 4.1 requires initial appearance within 24 hours of arrest.
