How does bail work in Arizona?
1. Constitutional Framework
Ariz. Const. art. II, § 22 (amended by Prop. 100) makes serious felonies, sexual assault, and certain offenses by undocumented immigrants nonbailable. Otherwise, bail is presumed.
2. Cash, Surety, Property, OR Bonds
Rule 7.3 lists conditions: ROR, unsecured appearance bond, third-party custody, secured bond (cash, surety, property).
3. Bail Hearing
Rule 4.1 requires initial appearance within 24 hours of arrest.
4. Bail Schedules
Counties may use bond schedules; Maricopa uses risk-based recommendations.
5. Bail Bond Agent / Bondsman
Licensed under A.R.S. § 20-340 et seq.; 10% premium typical.
6. Conditions
Rule 7.3(c) authorizes no-contact, no-firearms, GPS, drug testing, and pretrial supervision.
7. Bail Forfeiture
A.R.S. § 13-3974 and Rule 7.6 govern forfeiture; surety has 30 days post-judgment to seek remission.
8. Bail Reduction
Rule 7.4 allows modification on motion; appellate review by special action.
9. Pretrial Release Programs
County pretrial services offer supervised release in major counties.
