Trade Secret Protection Policy
Internal company policy establishing procedures for identifying, marking, and protecting trade secrets under state and federal trade secret law.
Instructions
Define what constitutes a trade secret in your organization. Establish procedures for identifying and marking confidential materials. Implement access controls (need-to-know basis, password protection, physical security). Require all employees, contractors, and visitors to sign NDAs. Document reasonable measures taken to maintain secrecy — this is required to claim trade secret protection under the Defend Trade Secrets Act and state UTSA laws.
