Student Discipline Appeal
Appeal of a student suspension, expulsion, or other disciplinary action, asserting procedural due process rights.
Instructions
File the appeal within the deadline specified in the school's student handbook, typically 5 to 10 days after the disciplinary decision. State the specific grounds for appeal: procedural error, disproportionate punishment, or new evidence. Request a hearing before the school board or appeals committee. For suspensions exceeding 10 days, students have due process rights under Goss v. Lopez (1975). Special education students have additional protections under IDEA's manifestation determination requirements.
