Special Education Due Process Complaint
Formal complaint initiating due process proceedings under IDEA when parents and the school district cannot agree on a child's identification, evaluation, placement, or services.
Instructions
File with your state's department of education. Include the child's name and address, the school, a description of the problem and supporting facts, and the proposed resolution. The school district has 15 days to resolve the complaint or proceed to a resolution session. If unresolved, a due process hearing is held before an impartial hearing officer within 45 days. The statute of limitations is generally 2 years from the date the parent knew or should have known about the issue.
