Plea Agreement
Written agreement between the prosecution and defense in which the defendant agrees to plead guilty or no contest in exchange for sentencing concessions or charge reductions.
Instructions
State the charges to which the defendant will plead guilty. Describe the prosecution's sentencing recommendation or agreement to dismiss other charges. Include the defendant's waiver of rights (trial by jury, confrontation of witnesses, privilege against self-incrimination). Address cooperation obligations if applicable. The defendant must sign acknowledging the agreement is voluntary and they understand the consequences. The judge is not bound by sentencing recommendations in most jurisdictions.
