Medical Malpractice Complaint

Establish the physician-patient relationship, the applicable standard of care, how the provider deviated from that standard, and the resulting injury. Many states require a certificate of merit from a qualified medical expert filed with or shortly after the complaint. Check your state's statute of limitations (typically 2 to 3 years from discovery of injury). Include claims for economic damages, pain and suffering, and loss of consortium if applicable.
