Complaint alleging sex-based wage discrimination under the Equal Pay Act of 1963, which requires equal pay for equal work regardless of sex.
Instructions
You may file directly in federal court without first filing an EEOC charge (unlike Title VII). Identify the comparator of the opposite sex performing substantially equal work in terms of skill, effort, responsibility, and working conditions. Document the pay disparity with pay stubs, offer letters, or other evidence. The statute of limitations is 2 years (3 years for willful violations) from the date of the last discriminatory paycheck. You may also file a concurrent Title VII sex discrimination charge with the EEOC.
