File within 180 days of the discriminatory act (300 days if your state has a fair employment practices agency). Include your name, address, and contact information; the employer's name, address, and number of employees; a description of the discriminatory act; the basis for discrimination; and the date of the violation. The EEOC will investigate and attempt conciliation. You must receive a Right to Sue letter before filing a federal lawsuit. Filing can be done online at the EEOC Public Portal.
