burglary

Burglary is a crime under both the common law and the model penal code . Exact definitions of burglary under the common law vary by jurisdiction though they all criminalize some form of illegally entering a building with the intent to commit a crime within. In some jurisdictions , this crime must be a felony to sustain a burglary charge. 

In a Model Penal Code (MPC) jurisdiction, burglary is defined as entering a building or structure with the intent to commit a crime therein unless that building or structure is open to the public at the time. Unlike in common law jurisdictions, burglary under the MPC does not require the offense to occur at night.
