Case summary
Prairie Farms Dairy (PFD) is a dairy cooperative which manufactures, distributes, and sells a wide range of products with facilities across the Midwest and Southern United States. After Dean Foods, Inc. declared bankruptcy, on May 1, 2020, PFD purchased 14 of its facilities. On February 17, 2021, PFD entered into a New Owner Auditing Agreement with the EPA to conduct a compliance audit on its newly acquired facilities. PFD completed its audits on July 29, 2022. These audits resulted in the company voluntarily disclosing multiple violations of Clean Air Act (CAA) section 112(r) across five (5) of 14 newly acquired facilities. Most violations related to failure to adhere to the multiple requirements set forth in 40 CFR Part 68 resulting in incomplete information or the failure to take steps to achieve compliance. Each violation has been remedied by submitting corrected or missing information and/or taking the required steps to return to compliance.
