Case summary

USA v. Inhance Technologies LLC (Inhance) complaint filed for violations of Section 15 of the Toxic Substances Control Act (TSCA), 15 U.S.C. Section 2614. EPA alleges that Inhance is engaging in ongoing significant new uses of multiple per- and polyfluoroalkyl substances (PFAS) that are subject to the Long-Chain Perfluoroalkyl Carboxylate and Perfluoroalkyl Sulfonate Chemical Substances Significant New Use Rule, 40 C.F.R. Part 721.10536. Under Section 5(a)(1) of TSCA, 15 U.S.C. Section 2604(a)(1), no person may manufacture or process a chemical substance for a significant new use except for when that person submits a Significant New Use Notice to the EPA and the EPA reviews that notice and makes a determination on that use under Section 5(a)(3) of TSCA, 15 U.S.C. Section 2604(a)(3).
