Greene, Tweed violated the Toxic Substances Control Act (TSCA) section 5 manufacturing and processing notices requirements and the Exemption for research and development requirements at 40 C.F.R. Part 723.36 when it failed to comply with the risk evaluation, notice, and recordkeeping requirements. Greene, Tweed also violated TSCA 8(c) for failing to keep records of significant adverse reactions to health and the environment alleged to have been caused by a chemical substance or mixture; and TSCA section 13, when it failed to certify correctly at the port of entry that a chemical shipment is subject to TSCA and is compliant with all applicable rules or orders as required by 19 C.F.R. 12.121(a).
