EPA v. Titanium Metals Corporation

Case summary

TIMET violated the Toxic Substances Control Act(TSCA) section 8(a), 15 U.S.C. 2607(a), and the Inventory Update Reporting Regulations promulgated thereunder at 40 C.F.R. Part 710, when it failed to submit accurately a Data Production and Site Report (Form U) for chemical substances manufactured or imported at the Henderson, NV and Toronto, OH facilities, as required for the 2006 Partial Updating of the TSCA Inventory. TIMET also violated TSCA section 13, 15 U.S.C. 2612, when it failed to certify correctly at the port of entry on forty-two (42) occasions that a chemical shipment is subject to TSCA and is compliant with all applicable rules or orders as required by 19 C.F.R. 12.121(a).
