Failure to notify the emergency planning committee of a facility representative who will participate in the local emergency planning process as a facility emergency response coordinator as required by EPCRA in 42 U.S.C. § 11003 and 40 C.F.R. § 355.20(c). 5. Failure to have appropriate Spill Prevention, Control, and Countermeasure (SPCC) Plans as required by CWA Section 311(j)(1)(C), 33 U.S.C. § 1321 (j)(1)(C), and 40 C.F.R. §§ 112.3 through 112.7.
