EPA and New Cingular Wireless (NCW) reached settlement agreement resolving noncompliance with Emergency Planning and Community Right-to-Know (EPCRA) reporting requirements related to the presence of sulfuric acid and diesel (325 sites); inadequate or no Clean Water Act (CWA) Spill Prevention Control, and Countermeasures Plans (SPCC) (14 sites); Clean Act (CAA) minor source permitting (2 sites) at 332 legacy-AWS sites located in 43 states. As a result of audits conducted pursuant to the consent agreement, AWS paid negotiated penalties of $51,800 for violations of the CWA SPCC requirements, and $270,100 for CAA violations, for a total of $321,900 in negotiated penalties.
