Case summary

The importer failed to submit as required by Section 7 an application for Registering a Pesticide, Device, or Active Ingredient Producing Establishment and failed to file the required production Reports; and when it sold and distributed a device which was misbranded in that its label failed to bear the establishment number of the production facility. The importer had to ensure that any and all of its products governed by FIFRA were produced at the facilities having an EPA establishment number and were properly labeled in accordance with FIFRA and EPA regulations.
