Case summary

Multi-regional Voluntary Disclosure resolved regarding EG Systems, Inc.’s (EG Systems) assessment of noncompliance with reporting requirements under the Emergency Planning and Community Right-to-Know Act (EPCRA). Based on the information provided by EG Systems, we have determined that EG Systems has met the nine conditions of EPA’s Final Policy Statement, Incentives for Self- Policing: Discovery, Disclosure, Correction and Prevention of Violations, 65 Fed. Reg. 19,618 (April 11, 2000) (Audit Policy), and therefore EPA will not seek any gravity-based penalties. We have calculated the economic benefit of EG Systems’ delayed compliance and have determined that it is insignificant, therefore, EPA will not seek to recover any economic benefit gained as a result of noncompliance.
