IMPORTER BROUGHT INTO THE U.S. ONE UNCERTIFIED PERKINS ENG INE 12/99 THAT LACKS A LABEL AND WHICH WAS SEIZED BY U.S CU STOMS. IMPORTER HAS SIGNED AN ASA IN WHICH THEY PAY $1,000 FINE TO CUSTOMS AND DO A LOOK BACK AT ALL NONROAD DIESEL ENGINES IMPORTED SINCE 1/1/96. UPON RECEIPT OF A LE TTER WITH ADDITIONAL INFORMATION AND STATING THE ABOVE IMPOR TER WILL BE ALLOWED TO SWAP THE UNCERTIFIED ENGINE FOR A CER TIFIED ONE. UPON RATIFICATION OF THE ASA IMPORTER WILL BE A LLOWED TO EXPORT THE UNCERTIFIED ENGINE TO A COUNTRY OTHER T HAN CANADA OR MEXICO. AS A PART OF THE SETTLEMENT IMPORTER A GREED TO PROVIDE A PLAN TO PREVENT FUTURE OCCURRENCES AND AG REED TO LOCATE AND INSPECT A 10% RANDOM SAMPLE OF THE NONROA D ENGINES IMPORTED SINCE JANUARY 1, 1996, FOR THE PURPOSE OF DETERMINING WHETHER THE ENGINES ARE CERTIFIED AND AN EPA EM ISSION LABEL IS PRESENT, LEGIBLE, AND READILY VISIBLE. RESU LTS OF THE SAMPLING WAS SUBMITTED AND NO VIOLATIONS WERE DIS CLOSED. CASE CLOSED.
