Case summary

This case addresses violations of the Clean Air Act (CAA) by Feldmann Engineering & Manufacturing Co., Inc. ( Feldmann ), a power tool manufacturer located in Sheboygan Falls, Wisconsin. On June 21, 2012 BSP imported 3,000 stand-alone small gasoline engines ( the subject engines ) into the into the Port of Portal, North Dakota. The Subject Engines bore emission control information (ECI) labels that do not meet the requirements of 40 C.F.R. § 1054.135 because the labels a) do not display a date of manufacture, nor is the date of manufacture stamped elsewhere on the engines, and b) do not contain the correct heading. As a result of this enforcement matter, Feldmann agreed to 1) install replacement ECI labels that comply with 40 C.F.R. § 1054.135; 2) submit a written report documenting that each Subject Engine received a complying label; and 3) pay a $12,000 civil penalty to the United States Treasury.
