Case summary

This case addresses violations of the Clean Air Act (CAA) by ROK-MIR, LLC ( ROK-MIR ), a construction contractor operating in Somerset, Kentucky. In June 2010 ROK-MIR imported 150 uncertified golf carts from China. ROK-MIR provided EPA with a forged certificate of conformity (COC) for these golf carts. The COC was an altered version of Certificate Number AXYEC.200SAI-003. This COC was issued to Xingyue USA, Inc. and covers only certain on-highway motorcycles. The subject vehicles were manufactured by a company named Yongkang Jinghang Industry & Trade Co., Ltd., not Xingyue USA, Inc. The golf carts also did not bear the required emissions label. As part of the settlement with EPA, ROK-MIR paid a $3,500 civil penalty and exported the golf carts outside of the United States, Mexico or Canada.
