EPA v. Champion Power Equipment

Case summary

This case addresses violations of the Clean Air Act (CAA) by Champion Power Equipment, Inc., a commercial equipment merchant in Santa Fe Springs, California. In January and February 2011, Champion Power Equipment imported from China 700 improperly labeled gasoline powered generators. The nonroad regulations under 40 Code of Federal Regulations parts 90, 1054 and 1068 prohibit any person from importing into the United States a new nonroad engine unless the engine is covered by an EPA-issued certificate of conformity (COC). These regulations also prohibit any person fiom importing into the United States a nonroad engine unless an appropriate label or tag is afixed to the engine. As part of its agreement with EPA, Champion Power paid a penalty to the US Treasury of $11,500. Champion Power also agreed to either relabel the 700 generators, export them outside of the United States or destroy them.
